Terms of Service
These Terms of Service (the “Terms”) govern access to and use of the platform and services provided by Recerc Inc., a Delaware C-Corporation (“Recerc,” “we,” or “the Company”). By using our services, you (“Client” or “User”) expressly agree to these Terms.
1. Scope and Acceptance
- These Terms apply to all Clients located in the Americas (North, Central, and South).
- If you use the Services on behalf of an entity, you represent that you are duly authorized to bind that entity.
- Geographical availability: the Services are not offered to residents of the European Economic Area (EEA) or the United Kingdom.
2. Services
- Recerc provides data-integration, automation, and synchronization tools (the “Services”).
- We reserve the right to improve, modify, or discontinue features with reasonable prior notice.
3. User Obligations
- Maintain the confidentiality of your credentials and promptly report any unauthorized access.
- Comply with applicable data-protection laws (e.g., Law 19.628 in Chile, the Mexican Federal Law on Protection of Personal Data, Law 1581 in Colombia, Law 29733 in Peru, and relevant U.S. federal or state law).
4. Intellectual Property
- All software, source code, trademarks, and content associated with the Services are the exclusive property of Recerc or its licensors.
- Users retain ownership of the data they upload to the platform.
5. Limitation of Liability
- The Services are provided “as is.” To the fullest extent permitted by law, Recerc’s total liability will not exceed the amount the User actually paid in the previous 12 months.
6. Termination
- Users may cancel at any time via the dashboard or in writing.
- Recerc may suspend or terminate access in the event of material breach or unlawful use.
7. Governing Law and Jurisdiction
- These Terms are governed by the laws of the Republic of Chile. Any dispute will be submitted to the ordinary courts of Santiago, Chile, without prejudice to non-waivable consumer rights in the User’s country of residence.
8. Changes
- Changes will be posted on this page at least 10 days in advance. Continued use constitutes acceptance.

Privacy Policy
At Recerc we take your privacy seriously. This Policy explains what data we collect, why we collect it, and how we protect it. It applies to the Recerc web application, mobile application, authenticated WebView experiences, APIs, and related support services.
1. Data We Collect
- Identifiers and account data: name, RUT/RFC/RUC, email address, phone number, user ID, workspace ID, authentication state, and session records.
- Usage, device, and diagnostic data: activity logs, IP addresses, device metadata, app version, locale, crash or error diagnostics, and security events.
- Integration and workspace data: information you sync from your own systems (ERP, CRM, databases, email, files, catalogs, quotes, orders, customers, and related workflows).
- User content: chat messages, prompts, uploaded files, generated documents, images, notes, and other content you submit to the Services.
- Mobile app data: the mobile app may store session tokens, selected workspace, chat state, and theme preference securely on your device using native secure storage. If you choose to attach an image, the app may access your camera or photo library only after you grant permission.
- Authenticated WebView data: mobile WebView screens may load authenticated Recerc web pages and use cookies or session state needed to keep you signed in.
2. Purposes of Processing
- To provide, maintain, secure, and improve the Services.
- To authenticate users, keep sessions active, select workspaces, and operate mobile and WebView experiences.
- To process chat, AI, file upload, quote, order, catalog, and integration workflows that you request.
- To deliver technical support, operational communications, analytics, diagnostics, and reliability monitoring.
- To comply with legal obligations, prevent fraud, investigate abuse, and enforce security controls.
3. AI, Analytics, and Service Providers
- AI features may send prompts, messages, uploaded files, and workspace context to AI service providers such as OpenAI only as needed to provide requested functionality.
- Analytics and diagnostic tools such as PostHog may process usage events, device metadata, and error information to improve reliability and product quality.
- Infrastructure, storage, email, payment, and integration providers may process customer data as subprocessors only as needed to operate Recerc.
4. International Transfers and Storage
- Your data may be hosted on cloud infrastructure located in the United States or other American countries. We enter into contractual safeguards that ensure an equivalent level of protection.
- We do not offer the Services to residents of the European Economic Area or the United Kingdom.
5. Data-Subject Rights and Account Deletion
- You may exercise access, rectification, erasure, objection, portability, or restriction by emailing legal@recerc.com with the subject “ARCO Rights.” We respond within 15 business days.
- Signed-in mobile users may also request account deletion from the mobile settings screen. Recerc verifies and processes account deletion requests according to legal, security, tax, accounting, and fraud-prevention obligations.
6. Security Measures
- Encryption in transit (TLS 1.2 or higher) and at rest where supported by the relevant storage system.
- Role-based access controls, least-privilege credentials, secure local device storage for mobile session data, and continuous monitoring.
7. Data Retention
- We keep data while a contractual relationship exists, while needed to provide the Services, or as required by local tax, accounting, legal, security, and fraud-prevention obligations.
- Uploaded files, chat history, logs, account records, and deletion requests may have different retention periods depending on workspace configuration and legal requirements.

Security and Subprocessors
Recerc uses a limited set of infrastructure and service providers to operate the app, protect accounts, process payments, send transactional emails, and support configured integrations. These providers process customer data only as needed to deliver the service.
